Arbitration

Arbitration is a method through which parties can settle their disputes in a timely manner. An Arbitrator listens to the parties’ arguments, reviews the submitted documents, and arrives at a decision that binds both parties. The process cuts down months if not years of litigation time thereby preserving each party’s time and money.

As opposed to litigation, Arbitration allows room for involvement in the process. For instance, parties can stipulate the number of arbitrators arbitrating the case, the location, the applicable law, or even the language of the Arbitration. Yet it must be noted that in the absence of a mutual intent to resort to arbitration, a clear and concise “Arbitration Clause” must be drafted for the case to be admitted to arbitration. It is worth noting that an Arbitrator is limited to the remedies in the applicable law and cannot come up with solutions that are not stipulated by law.

Our highly experienced experts, here at RAALC, are equipped to guide you through your arbitration cases and will provide you with unlimited consultations throughout.

Mediation

The downside to Arbitration is the severance of relationships that may sometimes occur as a result. Commercial and corporate relationships are designed to last long and be fruitful to all involved, hence, many parties are reluctant to seek Litigation or Arbitration and require yet another form of dispute resolution. Mediation is the right solution for you if “winning” your case is not in your best interests. This is the scenario if you are a large or medium sized corporation that has several ventures with the opposing party. One dispute should not cost you current or future ventures.

Mediation remains an infant in the field of Law, especially so in the MENA region, however the great results it yields cannot and should not be overlooked. Mediation is a voluntary process in which any party is free to leave and end the mediation.

However once a decision has been reached, the parties sign a settlement agreement that from then on becomes binding upon all. The remedies in a Mediation are unlimited and are often in the interest of both parties. This along with the swiftness and promptness of the process makes it an ideal Alternative for commercial and civil cases.

Our experts at RAALC Law Firm are certified mediators with a vast experience in Mediation. They will help guide you throughout the process and provide you with unlimited hours of consultations throughout.

Frequently Asked Questions

  • What is Arbitration?

Arbitration is a process of alternative dispute resolution, which is used for resolving conflicts between two or more parties without taking the matter to court. It is often a less difficult and less time-consuming process than a court trial. Through arbitration, the parties involved present their respective arguments, and then the arbitrator or arbitrators decide the outcome of the case, typically in an agreement that is fair for all involved. Arbitration also allows for a greater degree of control on the part of the parties, as they have a say in the choice of an arbitrator and the proceedings.

  • How does arbitration work in UAE?

The arbitration process in the UAE is governed by the Arbitration Law No. 6 of 2018 (the Law). It stipulates that parties in a dispute must first submit their claims to an arbitration tribunal, which is selected by both parties or appointed by the court. The tribunal will assess the merits of the claims, and then make a decision as to their validity.

  • What does request for arbitration mean?

Request for arbitration is a process in which two or more parties seek to resolve their dispute by submitting it to a third-party arbitrator. The arbitrator is an impartial mediator that hears the arguments of both sides and decides the outcome. The arbitration process is typically used in cases where it is difficult to settle a dispute through traditional means, such as through negotiation or litigation. Arbitration can be a faster, less expensive and less adversarial alternative to traditional forms of dispute resolution.

  • What happens if you lose in arbitration?

Arbitration is an alternative dispute resolution method that can be used when parties are unable to resolve their differences in court. The decision is generally binding and cannot be appealed, unless there is a clear violation of the law or a procedural error. Therefore, it is important to make sure that you fully understand the implications of arbitration before entering into such an agreement.
